1 Acceptance of Terms

By accessing or using Nudge ("the Service"), you agree to be bound by these Terms of Service. If you don't agree, don't use the Service.

These terms apply to all users including waitlist members, free tier users, and paid subscribers.

2 What Nudge Is (and Isn't)

Nudge is an AI-powered habit coaching app. It is designed to help you build and maintain personal habits through conversational AI and adaptive planning.

3 Your Account

To use Nudge beyond the waitlist, you'll need to create an account. You are responsible for:

• Keeping your login credentials secure
• All activity that occurs under your account
• Providing accurate information during sign-up
• Notifying us immediately if you suspect unauthorized access

You must be at least 13 years old to use Nudge. If you are under 18, you confirm you have parental consent.

4 Acceptable Use

You agree not to use Nudge to:

• Attempt to reverse-engineer, scrape, or exploit the AI system
• Submit false, misleading, or harmful content
• Circumvent subscription limits or payment requirements
• Use the service for any unlawful purpose
• Impersonate another person or entity

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5 Subscriptions & Billing

Nudge offers a free tier and a paid Pro subscription. By subscribing to Pro:

• You authorize us to charge your payment method on a recurring basis (monthly or annual)
• Subscriptions automatically renew unless cancelled before the renewal date
• You can cancel anytime — cancellation takes effect at the end of the current billing period
• We do not offer refunds for partial billing periods

6 Your Content

Content you create in Nudge — your habits, check-ins, and conversations — belongs to you. By using the Service, you grant us a limited license to store and process this content solely to provide the Service.

We do not claim ownership of your data. When you delete your account, your content is permanently deleted from our systems within 30 days.

7 AI-Generated Content

Nudge uses AI to generate coaching responses. You acknowledge that:

• AI responses are generated automatically and may not always be accurate or appropriate
• The AI coach is not a licensed professional and its advice should not replace professional guidance
• We are not liable for decisions you make based on AI-generated coaching
• We continuously improve the AI but cannot guarantee its accuracy at all times

8 Service Availability

We aim for high availability but do not guarantee uninterrupted access. We may:

• Perform scheduled or emergency maintenance that temporarily limits access
• Modify, suspend, or discontinue features with reasonable notice
• Change pricing with at least 30 days notice to existing subscribers

If we discontinue the Service entirely, we will provide at least 60 days notice and a prorated refund for any unused paid period.

9 Limitation of Liability

To the maximum extent permitted by law, Nudge and its team are not liable for any indirect, incidental, or consequential damages arising from your use of the Service.

Our total liability to you for any claim arising from these terms shall not exceed the amount you paid us in the 12 months prior to the claim.

10 Changes to Terms

We may update these terms from time to time. If we make material changes, we'll notify you via email at least 14 days before they take effect. Continued use of the Service after changes constitutes acceptance of the new terms.

The "last updated" date at the top of this page always reflects the current version.
